What we will do:

We guarantee that our silencers are free from defects both in materials and workmanship during the normal use lifetime of the silencer. If the need to have the silencer inspected or serviced at any time, when determined that the product is at fault, we will repair the product and return it to you free of charge.

Energetic Armament may also cover those occasional first “oops” at our discretion where the customer caused damage to the internals of the silencer by mistake and the serialized part was not damaged beyond repair. This courtesy does not extend to a second “oops.”

To obtain service under Energetic Armament’s Limited Warranty, you must follow these steps:

1.  Contact us by phone (617-966-9675) or e-mail (info@energeticarms.com) to troubleshoot the problem and obtain an RMA number. If we determine, at our sole discretion, that the problem is a manufacturing defect we may opt to provide a shipping label.
2. Ship the entire silencer to Energetic Armament, LLC, 13 Industrial Drive – Unit 1, Mattapoisett, Massachusetts 02739, and include:
   1. a photocopy of your form 4,
   2. a copy of your state or federally issued identification,
   3. a description of the problem, and
   4. complete contact and return shipping information (no PO/APO/FPO).
3. The silencer must be sent via UPS/FedEx with appropriate insurance and tracking.
4. We will inspect and repair the silencer if possible
5. We will return the silencer via UPS ground, Adult Signature Required, to the address provided with the RMA (no PO/APO/FPO).

What we cannot do:

We will service or repair only Energetic Armament products. We will not perform any service on a product not made by Energetic Armament.

Any returned silencer must be complete. It cannot be repaired if it is missing any parts. Energetic Armament cannot replace any missing parts—we can only repair damaged parts that are returned for service.

We will repair the product, if possible, but not all repairs may be possible and Energetic Armament accepting a returned silencer for warranty work does not guarantee that a repair is possible

We are prohibited by federal law from any repair that would deface the original serial number, including the serial ID ring for VOX and Nyx/Mod2 models. You acknowledge that if we must re-core a Vox model silencer, it requires drilling and re-swaging of the serial ID ring and the resulting permanent drill mark on the ring.

This Warranty does not cover normal wear, erosion, or cosmetic appearance of coatings on exterior or interior surfaces of the silencer. This warranty does not cover damage to either the silencer or host weapon resulting in whole or in part from: use in a criminal act, negligence or abuse, any type of modifications, careless handling, use of improperly loaded ammunition, or the use of surplus ammunition.  Energetic Armament assumes no liability for damages or bodily injury caused by these conditions. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

ENERGETIC ARMAMENT’S LIMITED WARRANTY DOES NOT APPLY TO NORMAL WEAR OR TO DAMAGE RESULTING FROM ACCIDENT, MISUSE, ABUSE OR NEGLECT, INCLUDING, WITHOUT LIMITATION, FAILURE TO FOLLOW CLEANING AND MAINTENANCE PROCEDURES DESCRIBED IN THE PRODUCT MANUALS. ENERGETIC ARMAMENT MAKES NO WARRANTIES OTHER THAN THE LIMITED WARRANTY EXPRESSLY SET FORTH IN THE LIMITED WARRANTY CERTIFICATE. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED; AND ENERGETIC ARMAMENT’S WARRANTY EXPRESSLY EXCLUDES ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES. (Some states do not allow limitations or exclusion of implied warranties, and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. Energetic Armament’s limited warranty gives you specific legal rights, and you may have other rights which vary from jurisdiction to jurisdiction).

Exclusive Remedy: Your exclusive remedy, and Energetic Armament’s sole obligation, is complying with the foregoing warranty policies within. Purchaser’s failure to make a claim as provided in this warranty or continued use of the product shall constitute an unqualified acceptance of such product and a waiver by you of all claims thereto.

Limitation of Warranty

EXCEPT FOR THE FOREGOING WARRANTIES, ENERGETIC ARMAMENT HEREBY DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY AND/OR ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR ANY WARRANTY WITH REGARD TO ANY CLAIM OF INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE. ENERGETIC ARMAMENT HEREBY DISCLAIMS ANY REPRESENTATIONS OR WARRANTY THAT THE PRODUCT IS COMPATIBLE WITH ANY COMBINATION OF NON-ENERGETIC ARMAMENT PRODUCTS OTHER THAN AS EXPRESSLY SET FORTH IN THE PRODUCT MANUAL.

Limitation of Liability

THE LIABILITY OF ENERGETIC ARMAMENT, IF ANY, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR DAMAGES FOR ANY CLAIM OF ANY KIND WHATSOEVER, REGARDLESS OF THE LEGAL THEORY AND WHETHER ARISING IN TORT OR CONTRACT, SHALL NOT BE GREATER THAN THE ACTUAL PURCHASE PRICE OF THE PRODUCT WITH RESPECT TO WHICH SUCH CLAIM IS MADE. IN NO EVENT SHALL ENERGETIC ARMAMENT BE LIABLE TO PURCHASER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, COMPENSATION, REIMBURSEMENT OR DAMAGES ON ACCOUNT OF THE LOSS OF PRESENT OR PROSPECTIVE PROFITS OR FOR ANY OTHER REASON WHATSOEVER.

MODIFICATION WARNINGS

Warranty Void: Altering or modifying parts is dangerous and will void the warranty. Energetic Armament components are manufactured to perform properly with original parts as designed.
